LIABILITY WAIVER AND RELEASE AGREEMENT
By signing below, I acknowledge and agree to the terms of the liability waiver outlined below:
1. Acknowledgment of Risks
I voluntarily agree to participate in the wellness services provided by Dips and Drips Hawaii, including sauna sessions and ice bath sessions. I understand and acknowledge that:
Sauna use involves exposure to high temperatures, which may cause dehydration, dizziness, or heat-related illnesses.
Ice baths involve exposure to extremely cold temperatures, which may cause shock, numbness, or other physical stress.
Improper use of the sauna or ice bath can result in injury, burns, or other adverse effects.
The mobile sauna contains hot surfaces, including the sauna heater and coals, which must not be touched under any circumstances.
2. Assumption of Risk
I acknowledge that I have consulted with a medical professional regarding my ability to safely participate in the Services, especially if I have or suspect I have any of the following conditions:
Heart disease, high blood pressure, or cardiovascular issues.
Brain conditions such as seizures or aneurysms.
Pregnancy or any condition that may be adversely affected by exposure to heat or cold.
I assume full responsibility for my health and safety while using the Services and understand that Dips and Drips Hawaii does not employ licensed medical professionals. Any benefits or results from the Services are not guaranteed.
3. Waiver and Release of Liability
In consideration of participating in the Services, I agree to release, waive, and discharge Dips and Drips Hawaii, its owners, employees, agents, and affiliates from any and all claims, liabilities, or damages arising from:
Injury, illness, or harm sustained during or after participation in the Services.
Property damage or loss while at Dips and Drips Hawaii's locations or using its equipment.
4. Terms of Use and Conduct
I agree to follow all instructions provided by Dips and Drips Hawaii staff, including but not limited to:
Avoiding contact with the sauna heater, coals, or other hot surfaces.
Entering and exiting the ice bath in a controlled manner.
Reporting any discomfort, dizziness, or unusual symptoms immediately.
I understand that failure to comply with these terms may result in immediate termination of my session without refund.
5. Booking, Payment, and Refunds
All purchases for Services are non-refundable.
Cancellations made at least 7 days prior to the scheduled event are eligible for a refund; cancellations within 7 days of the event are non-refundable.
Dips and Drips Hawaii reserves the right to refuse service to any individual for safety or operational reasons.
6. Agreement to Indemnify
I agree to indemnify and hold harmless Dips and Drips Hawaii, its owners, employees, and agents from any and all claims, damages, or losses resulting from my participation in the Services.
7. Photo and Video Release
I consent to Dips and Drips Hawaii taking and using photos or videos of me while I participate in the sauna and/or ice bath for promotional purposes. I understand that Dips and Drips Hawaii will be respectful of my privacy during these photo and video sessions.
